In the United States, both the states and the federal government have roles to play, and typically these roles will overlap, as in environmental standards set by each states and the federal government. Most of the instances we’ll look at on this textbook are civil cases. Criminal instances are certainly of curiosity to enterprise, particularly as firms may break felony legal guidelines.
Secondary guidelines fight the three main problems with authorized systems that primary guidelines cannot– uncertainty of the regulation, efficiency of the regulation, and static high quality of the law. Each sort of secondary rule addresses a separate one of those three issues, but all are interdependent.
The first strategy, analyzing in a exact means what the rule itself says, is usually known as the “positivist” faculty of legal thought.
